The Law of Ukraine "On the Public Health System" – a step towards European integration

Abstract

One of the main state duties is to ensure the value of human life and health. Due to this, the practice of public health systems implementation by state and non-state institutions has become widespread, recognized and widely used in the world. In order to fulfill European integration obligations, the Law of Ukraine "On the Public Health System" was adopted, which necessitates a clear understanding of Law’s content and norms, which will regulate not only measures for monitoring, response, and prevention of diseases in the country, but also the process of creating appropriate conditions for sanitary-epidemic well-being of the population, by all interested subjects, including market operators and product consumers. However, with the entry into force of the Law, a problem related to the sanitary and hygienic examination has arisen. While conducting the research a complex of general scientific and special research methods was applied, including a scientific analysis of the content and requirements of the Law of Ukraine "On the Public Health System" and other supplementary legislative and regulatory acts, their specification, comparison, synthesis, gene­ralization, summarization, determination of prospects for practical implementation, formulation of final conclusions. Based on the analysis of the provisions of the studied Law, it was established that it regulates the main principles, tasks, subjects, and their powers, defined the procedures for the implementation of the public health system, the implementation of state policy on the prevention and treatment of diseases, the promotion of a healthy lifestyle for people, and the extension of its term, quality in accordance with recognized world, in particular European, experience and realities. It was also established that the stipulated norms cause a legal conflict regarding guaranteeing the safety of the products presented on the market. The adoption of the Law of Ukraine "On the Public Health System" has a positive effect on the improvement of measures to ensure public health protection, in particular due to the updating of the provided norms, integration of the domestic system into the European one. However, the situation related to the certification and guarantee of the safety of the products presented on the market needs further refinement and regulation.
