On the issue of international legal responsibility of states

A doctrinal consideration of the features of international legal responsibility of states is presented based on its modern contractual, objectivist, and communitarian paradigm. The relevance of the study, considering the adoption in 2001 of the "Articles on the Responsibility of States for Internationally Wrongful Acts", lies in the necessity to logically separate the theoretical foundations of international legal responsibility of states from its normative model. Its nature and character are analysed in the context of representative and functional theories, as well as the forms of international responsibility of states, including the issue of the legal nature of countermeasures. The methodological toolkit of the study is based on the structural-functional method and the reconstruction method, which together make it possible to present the international legal responsibility of states as a holistic phenomenon in its action. The purpose of the study is to combine the achievements and potential of theoretical and philosophical models of the nature and character of international legal responsibility of states with the doctrine of the forms of the latter. The hypothesis of the study is the possibility of a holistic and functional presentation of the theoretical foundations of international legal responsibility of states. It has been proven that the theoretical foundations of the international legal responsibility of states are an imperfect, but fully functional conceptual structure that provides the basis for the corresponding developed international legal practice.
